How the deadline is calculated

The calculator follows the method the Information Commissioner's Office publishes:

  1. The month starts on the day you receive the request, whether or not that is a working day.
  2. The deadline is the corresponding calendar date in the following month.
  3. If there is no corresponding date, because the next month is shorter, the deadline is the last day of that month.
  4. If the deadline falls on a weekend or a bank holiday, it moves to the next working day.
  5. An extension for a complex request, or several requests from one person, adds up to two further months. You must tell the requester about it, and why, within the first month.

Bank holidays are those for England and Wales. Scotland and Northern Ireland have different bank holidays, so check the result if you operate there.

If you need proof of identity, the month starts when it arrives. If you hold a lot of information about the person and reasonably ask them to clarify their request, the clock pauses until they reply, then carries on. Add the paused days to the deadline.

For everything else about handling a request, read our guide to subject access requests for housing associations.
